Founding Athlete Beta Agreement

TUF Axiom Founding Athlete Beta Agreement This agreement is between you ("Athlete") and TUF Axiom ("we," "us"), operated by [LEGAL ENTITY NAME — attorney to confirm], Kansas City, MO. 1. The Beta Program. You are being granted free access to the athlete features of TUF Axiom as a Founding Athlete through December 31, 2026. This is beta software: features may change, break, or be removed, and access may be modified or ended at our discretion. Free beta access does not entitle you to free access after the beta ends. 2. Assumption of Risk. TUF Axiom provides training programs, readiness tracking, and nutrition guidance, including content generated by artificial intelligence. Physical training carries inherent risk of injury, including serious injury. You voluntarily assume all risks of using this app and following any program it provides. You agree to use your own judgment, train within your abilities, and stop any activity that causes pain. 3. Not Medical Advice. Nothing in this app is medical advice, diagnosis, or treatment. Consult a physician before beginning any training or nutrition program, and before returning to training after any injury or illness. 4. Release. To the fullest extent permitted by law, you release and hold harmless TUF Axiom, its owner, and its affiliates from any claims arising out of your use of the app or participation in the beta, including claims related to injury. This release is separate from, and in addition to, any waiver you may have signed at any TUF facility. 5. Feedback & Testimonials. In exchange for free access, you agree that we may (a) use your anonymized training data to improve the platform, and (b) contact you for feedback. We will not use your name, image, or identifiable results in marketing without your separate written permission. 6. Your Data. Our collection and use of your information, including health-related training data, is described in the Privacy Policy, which is part of this agreement. 7. Account. Keep your login private. Access is personal to you and may not be shared. 8. General. This agreement is governed by Missouri law. If any part is unenforceable, the rest remains in effect.
